Flats and maisonettes

Most of the easy house rules do not apply to flats.

A different starting point

Permitted development rights for extensions, dormers, porches and garden buildings are for houses. A flat or a maisonette usually needs a full application for the same work.

You may also need the freeholder’s consent under the lease. Planning permission does not override the lease. The lease does not override planning.

What people still do

Rear closets, loft space over a top flat, and winter gardens all get applied for. The council will look at the whole building, not just your flat, and at the neighbours above and below.

Check with your council. Rules change, and every house is different.

Questions

I own the maisonette. Is it a house?

Not for these rules. If it is a flat or a maisonette, assume the householder rights do not apply.

Do I need the freeholder?

Very often yes, because of the lease. Ask a solicitor before you spend money on drawings.
